Award ceremony of the Werner-Holtfort-Prize
This year’s RAV Congress will begin with the awarding of the Werner-Holtfort-Prize to the Italian criminal defense lawyer Francesca Cancellaro.
This prize honors outstanding legal commitment to human and civil rights.
The Werner-Holtfort-Foundation, who is also a co-organizer of the RAV Congress, was established by one of the most signifcant founding members of the RAV, the lawyer Werner Holtfort. The aim of the foundation is to impart knowledge and skills in order to uphold our work in the tradition of the fight for free advocacy and for a democratic legal system, for the defense against unlawful claims to power and for the right of future generations to an existence worth living in an undestroyed environment.
The award ceremony will also commemorate Werner Holtfort and his work as a lawyer. He has always fought for the protection of civil and human rights, against authoritarian structures and against arbitrariness in the state, especially in the judiciary. Ultimately, he battled for a society based on solidarity.
According to the decision of the Holtfort Foundation’s Board of Trustees, this year’s prize holder is Francesca Cancellaro, https://www.studiogamberiniassociati.it/avvocato/francesca-cancellaro.html, lawyer and criminal defense lawyer from Trieste, Italy.
Francesca is mostly active in the field of sea rescue. She was instrumental in the acquittal in the so-called Iuventa trial: The ship Iuventa set sail in 2016 to save lives in the Mediterranean Sea and to protest against Europe’s sealed-off borders.
The case of the Iuventa was to be another example of the systematic attempt to criminalize solidarity and restrict civil resistance throughout Europe. Instead, the Iuventa trial has become a symbol of the struggle for justice, transnational support, solidarity and resilience.
With little public awareness, the serious violations of the rights of people on the move remain a daily reality. However, other people continuously oppose this reality just as much. For example, the Italian judiciary is currently conducting several administrative and misdemeanor proceedings against people showing solidarity with migrants. In these proceedings, which directly reflect the prevailing state strategy of repression, Francesca plays an active part as a defense lawyer.
Francesca’s committed fight is both a role model and an inspiration to us. She and her successes are encouraging. These actions and achievements are honored with the awarding of the prize.
The laudatory speech will be given by Yiota Masouridou, a lawyer from Athens, Greece. In addition to her work in migration law, e.g. in the hotspots of the Greek islands in the Aegean, she defends against accusations of smuggling and police repression. She leads and accompanies several proceedings before the European Court of Human Rights and is a proven expert on push-backs, among other things.

Legal strategies against the criminalization of migration and practices of solidarity
The award ceremony will be followed by a discussion with Francesca and Yiota, facilitated by Carsten Gericke, a lawyer from Hamburg and member of the RAV.
In addition to their experiences as lawyers, we want to talk to them about their political and strategic analyses:
How do they classify the current attacks on the right to flight and freedom of movement in Europe as well as the strengthening of politically right parties and institutions?
Which counter-strategies are legally and politically possible and stand a chance of success?
What counter-project can we offer that makes the fight for the universal validity of fundamental rights and the democratic participation of all people attractive and credible?
The award ceremony and discussion will be held in English. Participants who do not understand English can obtain headphones for interpretation at the entrance to the lecture hall.

Die Verleihung erfolgt durch die Werner-Holtfort-Stiftung, die auch Mitveranstalterin des RAV-Kongresses ist. Sie wurde errichtet von einem der wichtigsten Gründungsmitglieder des RAV, Rechtsanwalt Werner Holtfort. Stiftungsziel ist, Kenntnisse und Fähigkeiten zu vermitteln, um sich in der Tradition des Kampfes für die freie Advokatur und für ein demokratisches Recht, für die Abwehr unrechtmäßiger Herrschaftsansprüche und für das Recht künftiger Generationen auf eine lebenswerte Existenz in einer unzerstörten Umwelt, einzusetzen zu können.
Im Rahmen der Preisverleihung wird auch an Werner Holtfort und sein Wirken als Rechtsanwalt erinnert werden, der stets für den Schutz der Bürger*innen- und Menschenrechte, gegen autoritäre Strukturen, Willkür im Staat und insbesondere in der Justiz und letztlich für eine solidarische Gesellschaft gekämpft hat.

Francesca verteidigt insbesondere im Bereich der Seenotrettung. Sie war maßgeblich beteiligt an dem Freispruch im sog. Iuventa-Verfahren: Das Schiff Iuventa ist 2016 in See gestochen, um Menschenleben auf dem Mittelmeer zu retten und gegen Europas abgeschottete Grenzen zu protestieren.
Der Fall der Iuventa steht beispielhaft für den systematischen Versuch überall im Europa Solidarität zu kriminalisieren und zivilen Widerstand einzuschränken. Stattdessen wurde das Iuventa-Verfahren zu einem Symbol für den Kampf um das Recht, transnationale Unterstützung, Solidarität und Widerstandsfähigkeit.
Abseits der Öffentlichkeit sind die schwerwiegenden Verletzungen der Rechte von Menschen auf der Flucht weiter alltägliche Realität. Genauso alltäglich stellen sich Menschen gegen diese Realität. So überzieht zum Beispiel die italienische Justiz solidarische Menschen mit Verwaltungs- und Ordnungswidrigkeitsverfahren. Francesca verteidigt in diesen Verfahren, in denen sich direkt die jeweils herrschende staatliche Repressisonsstrategie spiegelt.
Francesca ist uns mit ihrem engagierten Kampf Vorbild und Inspiration zugleich. Sie und ihre Erfolge machen Mut. Diese Handeln und Wirken soll mit der Verleihung des Preises honoriert werden.
Die Laudatio hält Yiota Masouridou, Rechtsanwältin aus Athen, Griechenland. Neben ihrer Arbeit im Migrationsrecht unter anderem in den Hotspots der griechischen Inseln in der Ägais, verteidigt sie gegen den Vorwurf der Schleusung oder gegen Polizeirpression. Sie führtund begleitet mehrere Verfahren vor dem Europäischen Gerichtshof für Menscnerechte und ist eine ausgewiesene Expertin unter anderem zu Push-Backs.
